Nodeful Terms of Service

By using Nodeful (“Nodeful”, “we”, “our”, or “us”), you agree to the following Terms of Service (“Terms”). These terms form a binding agreement between you (“you”, “your”, or “Customer”) and Nodeful. If you do not agree to these Terms, you may not use our services.

1. Services

Nodeful provides managed database hosting on a prepaid, pay-as-you-go basis. Services are delivered on a best-effort model with no explicit uptime guarantees. We may update, limit, or discontinue parts of the service at any time without prior notice.

2. Eligibility

You must be at least 18 years old to use Nodeful. If you are 13 to 17 years old, you may use the services only under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3. Accounts

You are solely responsible for safeguarding your account credentials. Any activity under your account is considered your responsibility. We may suspend or terminate your account at any time, with or without notice, for violations of these Terms or at our discretion.

4. Payments & Credits

Prepaid Credits: Services are billed through prepaid credits. If your balance reaches zero, services may be suspended or terminated without notice.
Auto-Recharge: If automatic recharge fails and your balance is low, we may notify you, but maintaining a positive balance is your responsibility.
No Refunds: All payments are final. We do not offer refunds under any circumstance, including service outages or cancellations.
Data Deletion: We may delete suspended services and associated data after your account is out of credit. Data retention is not guaranteed.

5. Acceptable Use

By using Nodeful, you agree not to:

Host or distribute malicious code, malware, or harmful software
Host or distribute pornographic or illegal content
Engage in activities that are unlawful, abusive, or disruptive

We reserve the right to immediately suspend or remove any content or account found in violation of these rules.

6. Service Availability

We make no guarantees regarding uptime, performance, or availability. Services are provided “as-is” and “as-available”.

7. Termination

We reserve the right to suspend or terminate your access at any time, with or without notice. Upon termination, we may delete your data without obligation to retain or return it.

You may terminate your account through your dashboard. No refunds will be issued upon termination.

8. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages including lost profits, data loss, or service interruptions.
Our total liability is limited to the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Nodeful (ThinkBetter OÜ), its employees, affiliates, and agents against any claims or expenses arising from your use of the services or violation of these Terms.

10. Privacy

Your use of Nodeful is governed by our Privacy Policy. By using the platform, you consent to our collection and use of your information as described therein.

11. Governing Law & Disputes

These Terms are governed by Estonian law. Any disputes shall be resolved by arbitration in Estonia or, at our discretion, by the competent courts of Estonia.

12. Changes to These Terms

We may update these Terms at any time. Changes will be posted at https://ndf.app/terms. Continued use of the Services after updates constitutes acceptance.

13. Miscellaneous

Severability: If any provision is found unenforceable, the remainder remains in effect.
No Waiver: Our failure to enforce any part of these Terms is not a waiver.
Entire Agreement: These Terms constitute the full agreement between you and Nodeful.
